We Are Organica SAGL wishes to inform you that, according to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals concerning the processing of personal data (hereinafter referred to as the 'European Regulation'), it is necessary to process your personal data collected automatically or provided by you through the navigation or use of the website (hereinafter referred to as the 'Website').
The data controller is We Are Organica SAGL, represented by the legal representative, domiciled at the registered office of Via Carlo Frasca 3, 6900 Lugano (hereinafter the 'Data Controller').
To allow you to use the Website and its services, the data controller needs to know and process some of your personal data.
By personal data, we mean information about an identified or identifiable natural person, such as, for example, name, contact information, IP addresses.
To respond to any information requests through the contact form, we will need to process the following personal data: name, surname, phone number, email address.

The computer systems and software procedures used to operate the Website acquire, during their normal operation, some personal data, the transmission of which is implicit in the use of Internet communication protocols.

The personal data of which the data controller becomes aware are exclusively those provided during navigation and/or when forwarding any information requests. Therefore, personal data will be processed to:
A) Allow the use of the Website;
B) Satisfy requests that may come through the contact form, also allowing us to contact you at the email address you have provided;
Considering the choice to use the services provided by the Website, the legal basis on which the processing of personal data is based may be:
- Express consent, by accepting the Cookie Policy and continuing to browse the Website;
The Data Controller intends to retain personal data for a period not exceeding that necessary for the purposes for which they were collected and processed.
Data on website contacts will not be stored for more than seven days unless they are necessary to establish liability in the event of hypothetical computer crimes against the Data Controller. Data related to requests containing personal data are deleted after months from receipt.
Regarding any other personal data, as the retention period cannot be precisely determined, the Data Controller commits to guiding the processing of personal data by the principles of adequacy, relevance, and data minimization, as required by the European Regulation. Therefore, once the purposes for which they were collected and processed are achieved, they will be removed from the systems or rendered completely anonymous.
The processed data will not be disclosed to third parties. However, individuals may become aware of the data, in relation to the processing purposes previously explained:
• Individuals who may access the data by virtue of legal provisions provided by European Union law or the law of the Member State to which the Data Controller is subject;
• Our employees, designated as System Administrators or acting under the authority of the Data Controller or Data Processor in accordance with the European Regulation;
• Data controllers belonging to our business group exclusively for internal administrative purposes;
• Individuals who, within the boundaries of the European Union, operate autonomously as distinct Data Controllers or as Data Processors appointed by the Controller, for purposes auxiliary to the activities and services described in paragraph 3, such as companies providing advertising, marketing, and communication services, IT and information technology services, design and development of websites, companies providing services for analyzing and developing data, and conducting market research.
Any communication of personal data will be in full compliance with the legal provisions of the European Regulation and the technical and organizational measures implemented by the Data Controller to ensure an adequate level of security.
The Data Controller may transfer data to third countries. Any such transfer will always be subject to adequate safeguards, as the destination country has obtained an adequacy decision from the Commission under Article 45 of the European Regulation, or standard contractual clauses as provided in Article 46(2)(c) of the European Regulation have been adopted.
The Data Controller does not use automated decision-making processes, including profiling as described in Article 22, paragraphs 1 and 4, of the European Regulation. Therefore, the Data Controller believes it is not necessary to provide information about the logic used, as well as the significance and consequences for the data subject related to this type of processing.
In relation to the processing of your personal data, under the European Regulation, the data subject has the right to:
• Withdraw consent to the processing at any time. However, it should be noted that the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal, as provided in Article 7(3) of the European Regulation;
• Ask the Data Controller for access to personal data, as provided in Article 15 of the European Regulation;
• Obtain from the Data Controller the rectification and integration of inaccurate personal data, even by providing a simple supplementary statement, as provided in Article 16 of the European Regulation;
• Obtain from the Data Controller the erasure of personal data if one of the reasons provided in Article 17 of the European Regulation exists;
• Obtain from the Data Controller the restriction of processing personal data if one of the cases provided in Article 18 of the European Regulation occurs;
• Receive from the Data Controller the personal data concerning them in a structured, commonly used, and machine-readable format and have the right to transmit this data to another controller without hindrance, as provided in Article 20 of the European Regulation;
• Object at any time, for reasons related to their particular situation, to the processing of personal data carried out under Article 6(1)(e) or (f), including profiling based on these provisions, as provided in Article 21 of the European Regulation;
• Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, unless they have given explicit consent beforehand, as provided in Article 22 of the European Regulation. As a purely illustrative and not exhaustive example, this category includes any form of automated processing of personal data aimed at analyzing or predicting aspects related to consumer and purchasing choices, economic situation, interests, reliability, and behavior;
• Lodge a complaint with a supervisory authority if they believe that the processing concerning them violates the European Regulation. The complaint can be lodged in the Member State of their habitual residence, work, or the place where the alleged violation occurred, as provided in Article 77 of the European Regulation.To exercise each of your rights, you can contact the Data Controller, in the person of the legal representative, by sending a communication to the legal address of Via Carlo Frasca 3, 6900 Lugano , or by sending an email to info@organica.agency, providing the following information:
- Name, surname, and postal address
- Details of the request
- Copy of a valid identity document.
To use the services provided through the website, one must be over sixteen years old. The consent to the processing of personal data of a minor under the age of sixteen is lawful provided that it is exercised by the person exercising parental responsibility.
